MILITARY SERVICE


CONFIDENTIALITY. Potential Independent Contractor acknowledges and agrees that during the pre-employment process they may have access to and become acquainted with SFI’s trade secrets, trademarks, inventions, customer lists, accounts, services, innovations, processes and procedures, information, records, and specifications owned or licensed by SFI and/or used by SFI in connection with the operation of its business (“Confidential Information”) during the employment and/or interview process. Potential Independent Contractor agrees that it will not disclose, either directly or indirectly, any of the Confidential Information to any third party. Potential Independent Contractor further agrees that it will not use the Confidential Information except in connection with Potential Independent Contractor’s pre-employment process and possible employment. All SFI files, records, documents, blueprints, specifications, letters, notes, original artwork, furnished notebooks and similar items coming into Potential Independent Contractor’s possession shall remain the exclusive property of SFI and shall be returned to SFI by Potential Independent Contractor upon the completion of the pre-employment and interview process, if the applicant isn’t presented an offer for employment. Potential Independent Contractor agrees to take all necessary and reasonable steps to preserve the Confidential Information during and after the pre-employment process. Potential Independent Contractor further agrees that it will not disclose to any third parties the fact that Potential Independent Contractor has been interviewed for possible employment with SFI.

NONSOLICITATION AND NONCOMPETITION. Potential Independent Contractor agrees that during the pre-employment process and for 84 consecutive months after the completion of the pre-employment process, if employment isn’t offered, it will not solicit business from any client of SFI in the State of Indiana or any state in which SFI provides professional security services for its Clients. Potential Independent Contractor further agrees that the non-competition and non-solicitation provisions of this application are necessary to protect SRI’s legitimate business interests, including, without limitation, the confidential business or professional information and trade secrets of SFI, the relationships between SFI and its clients, venders and subcontractors, and the goodwill of SFI. Both parties acknowledge and agree that any breach of this provision will result in irreparable injury to SFI. In the event there is a breach or threatened breach of this clause, SFI shall be entitled to seek and obtain injunctive relief without the posting of a bond in order to enforce the Potential Independent Contractor’s non-solicitation and non-competition clause. Potential Independent Contractor agrees to reimburse SFI for all costs and expenses, including attorney’s fees at the trial, the appellate levels and in bankruptcy court, in connection with SFI’s enforcement action. This provision does not limit any other rights and/or legal/equitable remedies available to SFI on account of Potential Independent Contractor’s breach of this clause.

DRUG/ALCOHOL TESTING CONSENT FORM. I hereby agree to submit to a drug or alcohol test and to furnish a sample of my urine, breath, hair and/or blood for analysis. I understand and agree that if I refuse to submit to a drug or alcohol test under company policy, or if I otherwise fail to cooperate with the testing procedures, I will no longer be considered for employment. I further authorize and give full permission to have SFI and/or its company physician send the specimen or specimens collected to a laboratory for a screening test for the presence of any prohibited substances under the policy, and for the laboratory or other testing facility to release any and all documentation relating to such test to the SFI.
